“Proceeds of Unlawful Activity” — Supreme Court Orders Final Forfeiture of Seven Luxury Properties and $2 Million Cash Linked to Godwin Emefiele

The Supreme Court of Nigeria has delivered a decisive ruling ordering the final and permanent forfeiture of seven high-value luxury landed properties, $2.045 million in cash, and share certificates linked to former Central Bank of Nigeria (CBN) Governor Godwin Emefiele to the Federal Government. In a unanimous judgment delivered by a five-member panel led by Justice Ibrahim Saulawa, the apex court set aside an earlier decision by the Court of Appeal in Lagos and reinstated the original ruling of the Federal High Court.

The legal battle stems from a November 2024 order by Justice Deinde Dipeolu of the Federal High Court in Lagos, which initially granted the Economic and Financial Crimes Commission (EFCC) a non-conviction-based forfeiture of the multi-billion-Naira assets. Although Emefiele successfully appealed the decision in June 2025—when the appellate court ordered a fresh hearing—the Supreme Court firmly ruled that the anti-graft agency had provided sufficient evidence proving the assets were acquired through illicit funds, bringing the prolonged court battle to a conclusive end.

The apex court's ruling permanently transfers ownership of several top-tier real estate holdings in prime commercial locations and liquid financial holdings directly to the Nigerian state.

The forfeited properties include two fully detached duplexes on Hakeem Odumosu Street in Lekki Phase 1, Lagos; an undeveloped parcel of land measuring nearly 1,920 square metres on Oyinkan Abayomi Drive in Ikoyi; a bungalow and a four-bedroom duplex on Probyn Road, Ikoyi; and eight units of apartments on Adekunle Lawal Road, Ikoyi.

The court also affirmed the forfeiture of an expansive industrial complex under construction situated across 22 plots of land in Agbor, Delta State, alongside another duplex on Bank Road in Ikoyi.

Beyond physical properties, the Federal Government officially reclaims $2,045,000 in cash and total share certificates belonging to Queensdorf Global Fund Limited Trust.

The apex court emphasized that the forfeiture was executed under civil in rem proceedings pursuant to Section 17 of the Advance Fee Fraud Act, meaning the assets are permanently confiscated independently of Emefiele's ongoing criminal trials in Lagos and Abuja.
