2027 Election: Court Clears Goodluck Jonathan, Dismisses Suit Challenging Eligibility

The Federal High Court sitting in Abuja has dismissed a legal challenge aiming to disqualify former President Dr. Goodluck Ebele Jonathan from contesting the 2027 presidential election, clearing any legal obstacles to his potential candidacy.

Presiding Judge, Justice Peter Lifu, delivered the final judgment in the high-stakes lawsuit marked FHC/ABJ/CS/2102/2025, which was instituted by an Abuja-based legal practitioner, Johnmary Jideobi. The court declared the suit as completely lacking in merit and described it as a blatant abuse of the judicial court process.

The plaintiff had approached the court seeking a definitive interpretation of Sections 1(1), (2), (3) and 137(3) of the 1999 Constitution (as amended). Jideobi argued that because Jonathan completed the unexpired tenure of the late President Umaru Musa Yar’Adua from 2010 to 2011, and subsequently served a full four-year term after winning the 2011 election, allowing him to contest in 2027 would breach statutory term limits. He maintained that a potential victory would mean Jonathan taking the presidential oath of office for an unprecedented third time, exceeding the cumulative maximum of eight years.

However, Justice Lifu rejected the plaintiff's arguments entirely, resolving the legal debate in favor of the former president. In a definitive victory for the defense, the court struck out the suit and slammed a heavy fine of ₦20 million in punitive costs against the plaintiff to be paid to former President Jonathan, alongside an additional ₦1 million award in favor of the Attorney-General of the Federation (AGF).

The ruling has immediately heightened political discussions across the country, especially as certain factions within the primary opposition party, the Peoples Democratic Party (PDP), have reportedly positioned Jonathan as a possible consensus contender to challenge the ruling All Progressives Congress (APC) in the 2027 general elections.
