Malami Accuses EFCC of Breaching Due Process in Abuja Eviction

Former Attorney-General of the Federation, Abubakar Malami, has accused the Economic and Financial Crimes Commission of forcibly evicting his family from his Abuja residence without a valid court order.

Malami alleged that operatives of the anti-graft agency, accompanied by armed security personnel, stormed his home in Maitama and carried out the eviction without presenting any legal authorisation.

He described the action as a violation of due process, insisting that the commission acted outside the bounds of the law by failing to obtain or present a subsisting court order before taking over the property.

The former minister further argued that the property in question remains subject to ongoing legal proceedings, noting that he had already challenged an earlier interim forfeiture order in court. He maintained that with the matter still pending, the EFCC ought to have awaited judicial determination rather than taking unilateral action.

Malami also contended that the interim forfeiture order previously obtained by the EFCC had expired and could not legally justify the agency’s actions.

The development adds to the ongoing legal tussle between Malami and the EFCC, with multiple cases involving alleged financial crimes and asset forfeiture currently before the courts.

The EFCC has yet to publicly respond to the allegations, as the dispute continues to raise questions over due process and enforcement procedures in high-profile anti-corruption cases.
