Lululemon Sues Costco Over Alleged “Dupes” of Its Signature Activewear

Lululemon has launched a federal lawsuit against Costco, alleging the retail giant is selling cheaper “dupes” of its most iconic products under the Kirkland Signature label. The 49-page filing, submitted in California, highlights several key items—including the Define jacket, Scuba sweatshirt, and men’s ABC pants—claiming cost-effective copies are so similar they risk confusing consumers and diluting Lululemon’s brand integrity .

According to the complaint, these Kirkland and third-party “knockoffs” are priced as low as $8–$20—vastly undercutting Lululemon’s $118–$128 originals. Lululemon argues that by not clearly distinguishing the products, Costco is misleading buyers into thinking they’re purchasing genuine Lululemon gear. The company asserts that this unauthorized copying has harmed its reputation, resulted in lost profits, and prompted widespread consumer confusion .

Lululemon is seeking unspecified monetary damages, a jury trial, and a court order forcing Costco to halt sales of the disputed items. This suit—filed July 1—marks another effort by Lululemon to protect its intellectual property, following similar actions in recent years, including a notable case against Peloton that culminated in a later partnerships.
